The payment of care home fees is a complex subject and depends on many things which are unique to you. The Scottish Government has been told it must rescind contracts awarded to multinational consultancy firms as work to create Scotland’s National Care Service continues. You'll have the option to create an individual account or link your account to an organisation. If your organisation is an SCVO member or supporter, you'll gain immediate access to exclusive content and benefits. This guide also provides information of where to get further help and support about the right care for you.
Health Boards and local authorities take forward the delivery and implementation of social care services based on the needs identified in the commissioning strategy. As services are often considered both health and social care, or are interconnected to other services, IJBs bring staff together for the delivery of integrated services. These services may be delivered by the local authority and/or Health Board directly employing staff themselves, or they may pay other companies or organisations to do so.

Alternatively they may also develop public social partnerships with third sector bodies . Public consultation, which ran from 9 August to 2 November 2021 included proposals to change responsibilities for the commissioning and procurement of social care services. Further engagement will take place to help understand barriers and opportunities to support the transition to a NCS and any tools / guidance that may be helpful going forward. How we identify need and then commission community health and social care services at a local level will look and feel different moving forward. Ethical Commissioning will become a cornerstone that the National Care Service will use to oversee continuity of approach at a local level. Continuity of approaches to commissioning, the process to determine needs and how we will deliver services, supports and solutions, will deliver better consistency of access across Scotland.
For integrated health and social care services, at present, local authorities and Health Boards delegate commissioning responsibility for the agreed services to integration authorities. For all but one area, the integration authority is the Integration Joint Board . In October, Health and Care Secretary Humza Yousaf announced the government would fund a payrise for care workers but delays allocating the cash to employers left some providers having to meet the costs themselves. The Scottish government told healthandcare.scot it “would encourage health and social care partners to continue to work closely with providers to ensure they receive the financial support they are entitled to”. We propose that the NCS will develop and manage a National Commissioning and Procurement Structure of Standards and Processes for ethical commissioning and procuring of social care services and supports. To advise public bodies involved in the commissioning and procurement of social care services of the action they can take now to prepare for the transition toward a National Care Service for Scotland .

She added that many homes, particularly smaller ones, were at risk of closing without a “significant” increase in support. Sources in the sector told healthandcare.scot they had struggled to get government officials to grasp the true extent of the looming problems. Funding models are also discussed in the report, and it is accepted that individuals should make a means-tested contribution to their accommodation costs, although not to their care which remains free at the point of need.
Consideration should be given to whether making full use of existing FAs / DPSs for ongoing call-off arrangements would fit with the ethical principles for a NCS. A contract established under the Public Contracts Regulations 2015 can be modified when certain grounds exist. Details of these grounds are summarised in Annex B – modification of higher value contracts. The definitions of Standard Residential Care, Standard Nursing Care, and Additional Care being developed as part of the National Care Home Contract will include reference to the level of equipment expected in each case.
Vision for the National Care Service
“The Scottish Government’s procurement directorate has recently issued an incredibly helpful policy note which says to commissioners and procurement officials - don’t wait for the National Care Service, start now. Check your procurement activity, make sure it’s in alignment with the principles of ethical commissioning and fair work. Most care services are coordinated through regional councils and...further text to explain the importance of council and care serve provision/funding. The proposed changes also aim to shift the thinking on social care to a system that sees social care as an investment in preventative/anticipatory care, rather than a crisis-based burden, and a service that is collaborative rather than competitive. Every year, local councils set standard rates that they'll pay towards care home fees. You can choose a care home that charges above your local council's standard rate, but you or a third party, like a relative, friend or charity will have to pay the difference between the price the council would usually expect to pay and the actual cost. The Act gives Scottish Ministers the power to publish standards which the Care Commission must take into account when making its decisions.
Care home contracts
The purpose of this Scottish Procurement Policy Note is to advise public bodies involved in the commissioning and procurement of social care services, of the action they can take now to prepare for the transition toward a National Care Service for Scotland . A care home sector actively managed by a national care service contract is one of the key recommendations for a new model of social care in Scotland. Integration Joint Boards and public bodies are asked to review their Strategic Commissioning plans, portfolio of social care contracts and pending procurement process and take action now to support a transition to a National Care Service. “The Independent Review recommended a revolution in commissioning, but the National Care Service proposals which came out in the consultation last year didn’t really follow through on that. I would go so far as to say that competitive tendering for social care is, in itself, unethical and no amount of tinkering around the edges is going to change that.
If, at inspection, or at other times, for example, as a result of the Care Commission looking into a complaint, there are concerns about the service, the Care Commission will take the standards into account in any decision on whether to take enforcement action and what action to take. The standards will be taken into account by the Care Commission in making any decision about applications for registration . All providers must provide a statement of function and purpose when they are applying to register their service.
Ethical and Sustainable Procurement ensures that these are not only delivered to the right quality, in a timely, efficient, legal, and commercially sustainable way, but that we use the power of procurement to meet those broader social, economic and environmental objectives agreed in the vision. “The financial support for social care provider arrangements include funding for infection prevention & control and PPE, and have demonstrated our commitment to supporting the sustainability and resilience of the social care sector. It is important to balance the need for new services or support with the risk of overcommitting budgets, resources and the market in the short term.
The principles are dignity, privacy, choice, safety, realising potential, and equality and diversity. The NCS will be responsible for market analysis and will work with partners to develop a thorough understanding of the market and share this information with CHSCBs.
Please bring this policy note to the attention of all relevant staff, including those agencies, non-departmental public bodies and other sponsored public bodies within your area of responsibility. In all cases, it is advisable to consider establishing contract terms with multiple options for extension and to include break clauses as standard to enable termination of the contract should policies change during the life of the contract. For example, novation or assignation clauses can facilitate a change in buyer or provider, to enable a third party, to take up the rights and obligations of the original contract.
The NCHC is to make terms and conditions, and publicly-funded placements, more equal across Scotland. You can choose to sign a contract directly with the care home for some or all your fees using 1 of 5 routes. This means that you may choose to move into a care home for the rest of your life.
